1. Acceptance of Terms

By accessing or using Greencarders ("the App", "the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Greencarders is a community platform designed for immigrants and individuals navigating the United States immigration process. The App provides discussion forums, news aggregation, groups, and a marketplace for immigration-related services.

Greencarders exists to support individuals lawfully navigating the United States immigration process, through community discussion, informational resources, and connections to licensed professionals. The Platform is fundamentally an educational and community resource. It does not support, facilitate, promote, or provide any pathway for illegal immigration, immigration fraud, or any activity intended to circumvent lawful immigration processes, and expects all users to pursue their immigration matters through lawful means.

3. Eligibility

You must be at least 18 years of age to use this App. By using the App, you represent that you are 18 or older.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate and complete information when creating your account.
• Greencarders reserves the right to suspend or terminate accounts that violate these Terms at any time, for any reason, without prior notice.

5. User Content

• You retain ownership of content you post on Greencarders.
• By posting content, you grant Greencarders a non-exclusive, royalty-free license to display, distribute, and moderate your content within the App and in marketing materials.
• You are solely responsible for the content you post.
• You agree not to post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• You agree not to post misinformation, particularly regarding immigration laws and procedures.
• Greencarders reserves the right to remove, edit, or moderate any content at our sole discretion without prior notice or liability.

6. Marketplace

• Greencarders provides a marketplace platform connecting users with immigration service providers.
• Greencarders does not endorse, guarantee, or assume responsibility for any services offered by third-party providers listed on the platform.
• Users engage with service providers at their own risk.
• Service providers are responsible for the accuracy of their listings and the quality of their services.
• Greencarders is not responsible for disputes between users and service providers.
• Greencarders reserves the right to approve, reject, edit, suspend, or permanently remove any service provider listing at any time without prior notice.
• Greencarders reserves the right to adjust listing prices, tier structures, and fees at any time with reasonable notice.

7. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Collect or harvest user data without permission
• Spam or send unsolicited messages
• Post false or misleading information
• Attempt to gain unauthorized access to the App
• Misrepresent professional qualifications or credentials
• Harass, threaten, or intimidate other users
• Use the App to facilitate, promote, or engage in illegal immigration activity of any kind, including but not limited to immigration fraud, forged or fraudulent documents, human smuggling or trafficking, providing false information to any government agency, or any attempt to circumvent lawful U.S. immigration processes

8. Intellectual Property

All content, features, and functionality of the App, excluding user-generated content, are owned by Greencarders and protected by applicable intellectual property laws. You may not use our name, logo, or branding without prior written consent.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. GREENCARDERS DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

No method of data transmission or electronic storage is 100% secure, and Greencarders cannot guarantee absolute security of your information despite implementing reasonable safeguards.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREENCARDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES.

This includes, without limitation, damages resulting from unauthorized access to, alteration of, or disclosure of your data, whether caused by a security breach, a third party's actions, or any other cause beyond our reasonable control.

11. Indemnification

You agree to indemnify, defend, and hold harmless Greencarders, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms.

12. Immigration Disclaimer

Greencarders is a community platform and does not provide legal, immigration, financial, or professional advice of any kind. Content posted by users or service providers should not be considered legal counsel. Always consult a qualified immigration attorney for legal advice specific to your situation.

13. Content Moderation

Greencarders reserves the right to moderate, remove, or edit any content at our sole discretion. We are not obligated to monitor all content but reserve the right to do so. Content moderation decisions are final.

14. Account Termination

Greencarders reserves the right to suspend or terminate your account immediately, without prior notice, for violations of these Terms, fraudulent activity, harmful behavior, or any action deemed detrimental to the Platform or its users. Upon termination, your right to use the App immediately ceases.

15. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules in Texas. You waive any right to a jury trial or class action lawsuit.

17. Changes to Terms

Greencarders reserves the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of significant changes through the App.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
