Greencarders ("the App", "the Platform") is operated by Evta Development LLC, a Texas limited liability company ("Greencarders", "we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. Description of Service
Greencarders is a community platform designed for immigrants and individuals navigating the United States immigration process. The App provides discussion forums, news aggregation, groups, and a marketplace for immigration-related services.
Greencarders exists to support individuals lawfully navigating the United States immigration process, through community discussion, informational resources, and connections to licensed professionals. The Platform is fundamentally an educational and community resource. It does not support, facilitate, promote, or provide any pathway for illegal immigration, immigration fraud, or any activity intended to circumvent lawful immigration processes, and expects all users to pursue their immigration matters through lawful means.
3. Eligibility
You must be at least 18 years of age to use this App. By using the App, you represent that you are 18 or older.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account.
You agree to provide accurate and complete information when creating your account.
Greencarders reserves the right to suspend or terminate accounts that violate these Terms at any time, for any reason, without prior notice.
You may delete your account at any time, from Settings in the App or at greencarders.com/delete-account. How we handle your data afterwards is described in our Privacy Policy.
5. User Content
You retain ownership of content you post on Greencarders.
By posting content, you grant Greencarders a non-exclusive, royalty-free license to display, distribute, and moderate your content within the App while it remains posted, and to use it in materials promoting the Platform. This license ends when your content is removed, except for copies held in routine encrypted backups, which expire on their own schedule of about ninety days, and copies we are required to keep by law.
You are solely responsible for the content you post.
You agree not to post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
You agree not to post misinformation, particularly regarding immigration laws and procedures.
Greencarders reserves the right to remove, edit, or moderate any content at our sole discretion without prior notice or liability.
6. Purchases and Subscriptions
Paid features are sold through the App Store and Google Play. Your payment is taken by the store, not by Greencarders, and the store's own terms apply to the transaction.
Subscriptions renew automatically until you cancel them. You cancel with the store: on iOS in Settings under your Apple Account subscriptions, and on Android in the Google Play app under Payments and subscriptions. Greencarders cannot cancel a store subscription on your behalf.
Refund requests go to the store that took the payment. Apple does not permit us to issue refunds for App Store purchases, and a store's decision is final.
Service provider listings and their paid tiers are also governed by our Service Provider Agreement, which prevails over this section if the two conflict.
7. Marketplace
Greencarders provides a marketplace platform connecting users with immigration service providers.
Greencarders does not endorse, guarantee, or assume responsibility for any services offered by third-party providers listed on the platform.
Users engage with service providers at their own risk.
Service providers are responsible for the accuracy of their listings and the quality of their services.
Greencarders is not responsible for disputes between users and service providers.
Greencarders reserves the right to approve, reject, edit, suspend, or permanently remove any service provider listing at any time without prior notice.
Greencarders reserves the right to adjust listing prices, tier structures, and fees at any time with reasonable notice.
8. Prohibited Conduct
You agree not to:
Violate any applicable laws or regulations
Impersonate any person or entity
Collect or harvest user data without permission
Spam or send unsolicited messages
Post false or misleading information
Attempt to gain unauthorized access to the App
Misrepresent professional qualifications or credentials
Give immigration legal advice unless you are a licensed attorney in good standing or a representative accredited by the Department of Justice through the Executive Office for Immigration Review
Harass, threaten, or intimidate other users
Use the App to facilitate, promote, or engage in illegal immigration activity of any kind, including but not limited to immigration fraud, forged or fraudulent documents, human smuggling or trafficking, providing false information to any government agency, or any attempt to circumvent lawful U.S. immigration processes
9. Intellectual Property
All content, features, and functionality of the App, excluding user-generated content, are owned by Evta Development LLC and protected by applicable intellectual property laws. You may not use our name, logo, or branding without prior written consent.
10. Copyright Complaints
If you believe content on the App infringes your copyright, send a notice to [email protected] including: identification of the work, identification of the content you say infringes it and where it appears in the App, your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your physical or electronic signature.
We will remove or disable content that is the subject of a valid notice, and we may terminate the accounts of repeat infringers.
If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. GREENCARDERS DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
No method of data transmission or electronic storage is 100% secure, and Greencarders cannot guarantee absolute security of your information despite implementing reasonable safeguards.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREENCARDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES.
This includes, without limitation, damages resulting from unauthorized access to, alteration of, or disclosure of your data, whether caused by a security breach, a third party's actions, or any other cause beyond our reasonable control.
To the extent the law allows, our total liability for all claims arising out of or relating to these Terms is limited to the greater of the total amount you paid us in the twelve months before the claim arose, or one hundred United States dollars. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
13. Indemnification
You agree to indemnify, defend, and hold harmless Evta Development LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms. This does not apply to the extent a claim arises from our own gross negligence or wilful misconduct.
14. Immigration Disclaimer
Greencarders is a community platform and does not provide legal, immigration, financial, or professional advice of any kind. Content posted by users or service providers should not be considered legal counsel. Always consult a qualified immigration attorney for legal advice specific to your situation.
15. Content Moderation
Greencarders reserves the right to moderate, remove, or edit any content at our sole discretion. We are not obligated to monitor all content but reserve the right to do so. If you believe a moderation decision was wrong, you may write to [email protected] and ask us to look at it again. We decide whether to change a decision, and our decision after any such review is final.
16. Account Termination
Greencarders reserves the right to suspend or terminate your account immediately, without prior notice, for violations of these Terms, fraudulent activity, harmful behavior, or any action deemed detrimental to the Platform or its users. Upon termination, your right to use the App immediately ceases. Terminating your account does not cancel a subscription you hold with a store. See section 6.2.
17. Apple and Google
These Terms are between you and Evta Development LLC only, not with Apple Inc. or Google LLC, and we alone are responsible for the App and its content.
Apple and Google have no obligation to provide any maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple and Google are not responsible for addressing any claim you or a third party has relating to the App, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms, and on your acceptance of these Terms they have the right to enforce them against you.
You represent that you are not located in a country subject to a United States Government embargo or designated as a terrorist-supporting country, and that you are not on any United States Government list of prohibited or restricted parties.
18. Governing Law
These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
19. Dispute Resolution
If you have a dispute with us, contact [email protected] first. Most issues can be resolved that way, and both sides agree to try in good faith for thirty days before starting formal proceedings.
If that does not resolve it, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules in Texas. You waive any right to a jury trial or class action lawsuit.
Either party may still bring an individual claim in small claims court instead of arbitration, if the claim qualifies.
20. Changes to Terms
Greencarders reserves the right to modify these Terms at any time. We will notify users of significant changes through the App, and the date at the top will change. Continued use of the App after changes constitutes acceptance of the new Terms.
21. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may transfer these Terms to a successor as part of a merger, acquisition, or sale of assets. You may not transfer them without our written consent.
Not enforcing a part of these Terms straight away does not waive our right to enforce it later.
Sections 5.2, 9, 11, 12, 13, 14, 18, 19, and 21 survive termination of your account.
Notices to you will be sent to the email address on your account, so keep it current.
